Driving with a child in the car comes with a lot of responsibility, especially when it comes to ensuring they are safely secured in a baby seat. Failing to position a baby seat correctly can result in significant fines and penalties for the driver.
The Highway Code specifies strict guidelines for child restraints in vehicles, requiring children under three to use suitable restraints in both front and rear seats. Children between three and 12 must also be secured appropriately, depending on their height and the availability of restraints.
It’s crucial to note that placing a rear baby seat directly facing an active airbag is strictly forbidden, as airbags, designed to protect adults, can pose serious risks to young children in the event of a collision. Additionally, positioning a child car seat in a side-facing seat is deemed unsafe and non-compliant.

While there are exceptions for taxis and private hire vehicles, and in cases of unexpected necessity over short distances, the general rule remains that children under 1.35m tall must be secured in a suitable baby seat, child seat, booster seat, or booster cushion, as per the manufacturer’s instructions.
The Road Traffic Act 1988 makes it clear that drivers are responsible for ensuring compliance with seatbelt regulations, with fines of up to £500 for failing to secure a child under 14 in the proper car seat. Despite medical exemptions, the mandatory use of seatbelts applies in most cases, with accommodations made for pregnant women and individuals with disabilities.
Understanding and adhering to the latest seatbelt requirements outlined in the Highway Code is essential for all drivers and passengers.
