Man Ordered to Demolish Illegal Flats Built in Gloucester Barn Following Planning Appeal Rejection

Sean Gorman, a resident of Severnside Farm in Walham, Gloucester, has been ordered to dismantle flats he constructed illegally within a barn on his agricultural land. Gloucester City Council found that the buildings violated planning regulations, as they were erected without permission in a flood risk area.

The 58-year-old received an enforcement notice demanding the removal of all fixtures, including wiring and plumbing, that enabled the structures to be used as residential flats. Gorman challenged the notice, appealing to the government’s planning inspectorate.

He argued the enforcement order did not apply to him, citing his gypsy status—a protected characteristic—claiming the notice was improperly served. However, the planning inspector rejected these arguments, confirming Gorman had been personally served and had ample opportunity to seek legal advice and appeal.

Gorman also maintained that the flats had been in continuous use since 2020, over four years, to dispute the enforcement. The inspector dismissed this, citing inconsistent evidence and a lack of valid tenancy agreements before 2023. Witness testimonies were described as contradictory, further weakening Gorman’s case.

The inspector has given Gorman six months to comply by stopping the residential use and removing the illegal modifications. Failure to comply may result in further legal action.

Gloucester City Council emphasized their commitment to upholding planning laws, stating, “Our regulations protect the city from unauthorized developments and ensure it functions properly. We will take necessary action against those who bypass proper permission processes.”
