As wet weather continues across the UK, drivers are being reminded of a crucial but often overlooked road rule that could lead to fines up to £5,000. Despite being seasoned at handling rain-soaked roads, many motorists remain unaware of the serious consequences of splashing pedestrians when driving through puddles.
A popular TikTok account, Driving Test Success, highlighted this issue with a video showing the correct approach to puddles: drivers should slow down and give as wide a berth as possible to prevent splashing pedestrians. The warning couldn’t be clearer—speeding through puddles and drenching someone can result in a fine as steep as £5,000.
Under the Road Traffic Act 1988, splashing a pedestrian is considered “driving without reasonable consideration for other persons.” The typical penalty includes a £100 fixed fine and three points on the driver’s licence. However, penalties can escalate dramatically if the act is deemed intentional or if the initial fine goes unpaid and the case proceeds to court, potentially resulting in a £5,000 maximum fine.

Public reaction reflects just how unaware many are of this regulation. Some have shared personal experiences being soaked by vehicles, unaware that legal action was an option. This rule not only protects pedestrians but also encourages courteous and attentive driving during adverse weather conditions.
Simon Williams, RAC’s head of policy, reinforced the message in 2018, emphasizing that even inadvertent splashing can bring penalties and that inconsiderate driving may lead to serious fines or points on a driver’s licence.
As rainy weather persists, motorists should exercise extra caution, ensure they drive considerately near pedestrians, and remember that what seems like a minor misstep could carry a significant financial penalty.
